TERMS AND CONDITIONS: 

RATES AND LABOR

Rates include labor, gas for truck and equipment, equipment usage, insurance for vehicles, general liability insurance, supplies and materials, and  time spent on projects among other costs. Additional fees apply for jobs that are outside of a 5 mile radius from the business location.

RECURRING SERVICES

Recurring services are completed weekly March through October. Customers are automatically enrolled in winter services with the ability to opt out. Customers will receive a 5% discount if they pay for 10 recurring weekly services in a lump sum.

PET POLICY

All pets must be kept off of the job site when workers are present and completing jobs.

There is a minimum charge of $10 for any pet waste that is on the job site and in the working space.

UTILITIES

For projects that require digging, Howden Brothers Landscaping is responsible for calling 811 so that the city can come and mark underground lines belonging to the state. Customers are responsible for marking private lines not covered by the state (e.g. low-voltage lighting, private septic, or irrigation).

UFORESEEN SITE CONDITIONS

In the event of unforeseen conditions that were not visible during an initial assessment, (stumps, large rocks, hidden garbage) Howden Brothers Landscaping may have to charge for extra labor in that event.   

LATE FEES

Customers will have 6 days to to pay from the date that the invoice is billed after a job is completed. There is a 10% of total job late fee charge for payments that are received after 6 days from being billed. There is a 50% late fee charge for payments that are received after 30 days from being billed. Recurring services will be paused if invoice remains unpaid after 6 days. 

TAXES AND FEES

Customer agrees to pay all applicable federal, state, and local taxes arising from the services performed under this agreement.

Texas Sales Tax: All landscaping services, including installation, maintenance, and materials provided within the State of Texas, are subject to Texas Sales and Use Tax. The current applicable sales tax rate of 8.25% (8 and 1/4 percent) is itemized separately on all estimates and invoices.

This tax is calculated on the total contract price, which includes all labor, materials, and equipment usage, as required by Texas Tax Code regulations. The customer shall be responsible for any additional taxes assessed by the Texas Comptroller in the event of an audit.

PAYMENT METHODS

Forms of payment that are accepted include cash, check, credit card, and Zelle. For jobs exceeding $5,000 a 50% down payment is required before work begins. 

ESTIMATE AND QUOTE VALIDITY PERIOD

Estimates, quotes, and bidding prices are valid for a period of up to 15 days due to fluctuating material costs. 

INSURANCE

Howden Brothers Landscaping carries general liability and vehicle insurance in order to protect property owners.
